The petitioner seeks bail in connection with Lakhisarai P.S. Case No. 513 of 2023 registered for the offence under Sections 414 of the Indian Penal Code. As per the prosecution case, the petitioner is alleged to have been in possession of stolen motorcycle whereas the learned counsel for the petitioner submits that the petitioner was having the documents of the motorcycle and the petitioner is the registered owners.

Learned counsel for the petitioner submits that the petitioner is in custody since 12.07.2023.

Considering the period of custody, this application

Patna High Court CR. MISC. No.66857 of 2023(2) dt.16-10-2023 2/2 for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case No. 513 of 2023.

The Superintendent of Police, Lakhisarai is directed to see to it that innocent persons who are found in possession of their own motorcycle should not be sent to jail. If on verification it appears that the petitioner is the owner of the vehicle, the Superintendent of Police, Lakhisarai will take steps for submitting Final Form in favour of the petitioner. Let a copy of this order be communicated to the Superintendent of Police, Lakhisarai, through FAX or e-mail forthwith.
