2. In this case, the petitioner is seeking regular bail in connection with S.T. No. 71 of 2024 arising out of Mahila (Muzaffarpur) P.S. Case No. 61 of 2021, registered for the offences punishable under Sections 448, 376, 493, 379, 420 of the IPC

3. As per prosecution case, the petitioner, on the false pretext of marriage assaulted the informant physically and later on, he refused to solemnize marriage with the informant.

4. Learned counsel for the petitioner is innocent and has falsely been implicated in the present case. He has further submitted that the relation of the informant with the petitioner was consensual. He further submitted that charge-sheet has been submitted and the petitioner is under custody since 01.11.2023.

5. On the other hand, learned APP for the State has vehemently opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, POCSO-3, Muzaffarpur in connection with S.T. No. 71 of 2024 arising out of Mahila (Muzaffarpur) P.S. Case No. 61 of 2021, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
