In this case, the petitioner is seeking anticipatory bail in connection with Kalyanpur P.S. Case No.106 of 2017, registered for the offence punishable under Sections 341, 504, 506 and 353/34 of the Indian Penal Code.

As per the allegation, the informant is the security guard, at about 12:30 am. he has seen a suspicious man moving around and when the informant inquired, he started hurling abuses and threatened that he should do his job of security guard. Later on, he has received a call on his mobile from Santosh Kumar, present petitioner, who also threatened him for dire consequences.

Patna High Court Cr.Misc. No.41191 of 2017 (2) dt.04-10-2017 2/2 Learned counsel for the petitioner submits that the material does not substantiate the allegation. He further submits that merely forbidding the informant to do the job of security guard will not constitute an offence.

Looking to the facts and circumstance of the case, let the petitioner, namely, Santosh Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Kalyanpur P.S. Case No.106 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
