Case No. 124 of 2015, registered under Section 302, 201 and 120(B) of the Indian Penal Code. Therefore, both the aforesaid applications have been heard together and are being disposed of by this common order.

Heard learned counsel for the petitioners and the

Patna High Court Cr.Misc. No.51147 of 2015 (3) dt.08-02-2016 2/3 learned A.P.P. for the State.

The petitioners are accused in connection with Ujiarpur P.S. Case No. 124 of 2015, registered under Section 302, 201 and 120(B) of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that the name of the petitioners have come in the confessional statement of accused Punam Devi as defined in paragraph 29 of the case diary in which she has stated about relations with Ajit Kumar (deceased) as well as accused Santosh Kumar Ram and she raised suspicion about committing the murder of deceased Ajit Kumar by the petitioners. Latter on wife and mother of the deceased, in para 34 and 35 of the case diary, raised suspicion against both the petitioners having hand in the murder of deceased. Thereafter, Police recorded the confessional statement of Santosh Kumar Ram showing his involvement and the involvement of petitioner Ram Lal Sahni and others in committing the murder, except the confessional statement, there is nothing against the petitioners on the record. The petitioners have no criminal antecedents and they are in custody since 23.07.2015.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released

Patna High Court Cr.Misc. No.51147 of 2015 (3) dt.08-02-2016 3/3 on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Dalsing Sarai, Samastipur in connection with Ujiarpur P.S. Case No. 124 of 2015.
