2. The petitioner is seeking regular bail in connection with Excise P.S. Case No. 238 of 2024 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per prosecution case, there has been recovery of total 80.080 liters of illicit liquor from the house of the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered from the conscious possession of the petitioner. Provision of

Patna High Court CR. MISC. No.66782 of 2024(2) dt.26-09-2024 2/2 Section 100 of Cr.P.C has not been complied in this case while preparing the seizure list. Petitioner is a man of clean antecedent. He is under custody since 27.06.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances of the case as well as petitioner having clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.1, Rohtas at Sasaram in connection with Excise P.S. Case No. 238 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
