JUSTICE SUDHIR SINGH ORAL ORDER 10-02-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Manjhagarh P.S. Case No. 95 of 2015 instituted for the offences punishable under Section 304B/34 of the Indian Panel Code.
As per prosecution case, the informant, namely, Bipin Bihari Singh alleged that he had married his daughter Putul Kumari with accused Pankaj Kumar Singh alias Prince Kumar on 27.04.2015 and the accused persons used to demand dowry in the shape of Generator, Cooler, gold ornaments and Rs. 2,00,000/- cash and also tortured her for non-fulfillment of the dowry
Patna High Court Cr.Misc. No.51806 of 2015 (5) dt.10-02-2016 2/3 demand. Further, the informant was informed by the villagepeople of his daughter's sasural that his daughter was murdered. The informant along with his family members and villagers reached at the door of his son-in-law, he saw that there was scar mark in the neck of his daughter Putul Kumari which shows that she was killed by tying rope around her neck. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioner no. 1 is the father-in-law of the deceased and petitioner no. 2 is the mother-in-law of the deceased. They are separate in mess and property from the husband of the deceased. They have no concern with the affairs of the husband of the deceased and the husband of the deceased is in custody.
On behalf of the State and the counsel for the informant, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class,
Patna High Court Cr.Misc. No.51806 of 2015 (5) dt.10-02-2016 3/3 Gopalganj in connection with Manjhagarh P.S. Case No. 95 of 2015, on subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
