The petitioner apprehends his arrest in a case under Sections 419, 420, 467, 468, 469, 471, 120(B) of the Indian Penal Code and Section 10 of the Examination Control act, 1982. The allegation against the petitioner is that Pintu Kumar was appearing on his behalf in the Post Graduate Examination. Pintu Kumar was apprehended on the spot. Learned counsel for the petitioner submits that the petitioner is innocent. He was also appearing at the examination but false case has been lodged.

It appears that the petitioner set up Pintu Kumar to appear at the examination on his behalf to get good marks. Pintu Kumar was apprehended.

Having considered the facts aforesaid, I am not

Patna High Court Cr.Misc. No.51632 of 2015 (3) dt.18-12-2015 2/2 inclined to enlarge the petitioner on anticipatory bail in Tatarpur (University) P.S. Case No. 100/2015. Accordingly the same is rejected.

The petitioner, if so advised, may surrender in the court below and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner taking into consideration that Pintu Kumar has already been enlarged on regular bail.
