19-09-2017 Heard Sri Sadanand Roy, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 15-05-2017 in Kargahar P.S. Case No. 124 of 2017 registered for offence under Sections 30(a) and 35 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that recovery of huge quantity of Indian make foreign liquor was shown from the bank of a river and petitioner has been made accused, as if, petitioner has confessed his guilt before the police.

Considering the nature of accusation and period of custody, let the petitioner namely Chandan Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand)

Patna High Court Cr.Misc. No.41690 of 2017(2) dt.19-09-2017 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Court, Excise, Rohtas at Sasaram in connection with Kargahar P.S. Case No. 124 of 2017.
