Petitioner apprehends arrest in registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

As per prosecution case, 20 liters of county made liquor was recovered from motorcycle of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to village politics. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel for the State opposes the prayer for bail submitting that the petitioner is owner of the motorcycle from which 20 litres of county made liquor has been recovered

Patna High Court CR. MISC. No.65682 of 2022(2) dt.16-12-2022 2/2 and as such he cannot escape liability for the same. Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
