1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Munger Complaint Case no. 139C of 2023, registered under sections 420, 323, 406, 418, 464, 465, 467, 468, 471, 474 and 506 of the Indian Penal Code.
3. As per the prosecution case, the complainant states that she gave Rs.50,910/- to the petitioner for getting a L.I.C. policy. She was given the policies in her name as also in the name of her husband and daughter. As there was some mistake, she gave the same for correction but the petitioner was not returning
Patna High Court CR. MISC. No.73321 of 2024(2) dt.11-11-2024 2/3 the same. On inquiry being made, it transpired that no policies had been issued in the name of the complainant and her family members by the L.I.C. and the same were forged. As such, the complaint.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. In reference to the copies of the L.I.C., brought on record as Annexure-3 and Annexure-4 series, it is submitted that the policies were issued in the name of the complainant and her family members which lapsed subsequently due to non-payment of the premium on time. The allegations levelled are false and concocted. The petitioner has no criminal antecedent.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the complaint together with the submissions made and the copies of the policies brought on record as Annexure-3 and Annexure-4 series to the petition, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Munger
Patna High Court CR. MISC. No.73321 of 2024(2) dt.11-11-2024 3/3 Complaint Case no. 139C of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Munger.
