The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 323, 354 and 379 of the Indian Penal Code and Sections 3 / 4 of the Scheduled Castes and Scheduled Tribes ( Prevention of Atrocities ) Act. Allegation against the petitioners is that they assaulted the informant and her daughter-in-law for a petty matter and had taken away Rs.2000/- from the house of the informant. It is submitted on behalf of the petitioners that they have got no criminal antecedent. The occurrence is said to have taken place on 4.5.2015 but the complaint was filed on 28.5.2015, for which no explanation has been made in respect to the delay in filing of the complaint case. The occurrence is said to have taken place at the house of the informant. Hence, no offence under SC and ST Act is attracted in the present case.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

No.52658 of 2015 (3) dt.19-02-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Falka (Pothia) P.S. Case no. 156 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
