The petitioners apprehend their arrest in Mansurchak P.S. case No. 31 of 2019 registered under Section 272, 273 of the IPC and u/s 30(a) of the Bihar Prohibition & Excise Act. The informant disclosed that during the course of election raid was conducted in village Kastoli, Agapur and Sohilbara and from the house of petitioners 2000 liter each toddy was recovered. The toddy was destroyed immediately after recovery.

The learned counsel for the petitioners submits that no seizure list is prepared. The place of recovery is not mentioned in the FIR but it appears that houses of the petitioners were

Patna High Court CR. MISC. No.59347 of 2019(2) dt.25-09-2019 2/2 raided and from the houses of the petitioners 2000 liter each toddy was recovered.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
