The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code.

The prosecution case is that all the FIR named accused persons including the petitioner came at the door of the informant and started abusing when it was protested, accused persons assaulted on the head of the informant with iron rod. It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled and injury has been found to be simple in nature. There is no accusation of repeating the blow.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.54356 of 2015 (2) dt.01-12-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Kishanganj P.S. Case No.326 of 2015, pending before the learned CJM, Kishanganj.

With the above observation, this application is, accordingly, disposed off.
