The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324, 379, 380, 427 of the Indian Penal Code.

Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 2 namely Ramchandra Yadav since he has been arrested.

Permission is accorded.

Patna High Court CR. MISC. No.1659 of 2022(2) dt.27-07-2022 2/3 Accordingly, the petition with respect to petitioner No. 2 is dismissed as withdrawn.

It is alleged that all the accused persons including the petitioners assaulted the informant and other family members of the informant, as a result of which, they sustained injuries.

It is submitted by learned counsel for the petitioner that in the background of some land dispute, this false case has been lodged against the petitioner. There is general and omnibus allegation against the petitioner. It is further submitted that at earlier point of time, the petitioner's side lodged Bisfi P.S. Case No. 43 of 2021 against the informant and others. Hence, in order to put pressure upon the petitioners, this false case has been registered against the petitioner. A statement has been lodged in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner No. 1, above named, in the event of his

No.1659 of 2022(2) dt.27-07-2022 3/3 arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani in connection with Bisfi P.S. Case No. 63 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
