The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 504, 307 and 506/34 of the Indian Penal Code. The specific case of the prosecution is that the FIR named accused persons came to the door of the informant and abused the informant. On protest being made coaccused Mithu Singh assaulted with lathi on the head of the informant and co-accused Balram Singh and Ramcharitra Singh assaulted with legs, fists and slaps. Petitioner was not named in the FIR. His name subsequently sprang up during investigation. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.53604 of 2015 (2) dt.26-11-2015 2/2 petitioner that the specific accusation of assault is not alleged against the petitioner. The specific accusation of making assault on the head has been alleged against Mithu Singh. Though, the injury has been found simple.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 92 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
