The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,324,307,504,506 and 379/34 of the Indian Penal Code. The prosecution case is that in the background of partition dispute the petitioner being cousin of the informant assaulted Dashrath Das with Dabia.

It is submitted by the learned counsel for the petitioner that for the occurrence of 1.8.2015 at 9 A.M. the FIR was registered on 2.8.2015 at 11 A.M. The injury has been found to be simple in nature. There is no accusation of repeating the blow. Statement has been made in paragraph 3 of the petition that

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Dandkhora P.S. Case no. 43 of 2015 pending in the court of learned CJM, Katihar. This application is disposed of with the aforesaid observation/direction.
