The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that on 30.09.2015 at 1.00 P.M. the son of the informant was in the grain field when accused persons Mahendra Chaudhary, Sharda Devi, Sudesh Chaudhary and the petitioners came and on the order of coaccused Mahendra Chaudhary , co-accused Sudesh Chaudhary assaulted with axe repeatedly on the chest, stomach and neck of

Patna High Court Cr.Misc. No.54806 of 2015 (3) dt.14-12-2015 2/2 the son of the informant, who succumbed to the injury. It is submitted by learned counsel for the petitioners that no overt act has been alleged against the petitioners and Mahendra Chaudhary and Sudesh Chaudhary are in custody. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Motihari, East Champaran in connection with Fenhara P.S. Case No. 55 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
