The petitioner apprehends his arrest in Sono P.S. Case No. 181 of 2014 instituted for the offence under Sections 342, 323, 325, 307, 504, 506/34 of Indian Penal Code. It is alleged that the informant is a government teacher and when he was coming to school and wanted to open the school, in the meantime, 3-4 unknown miscreants assaulted on head of informant by small weapon. They also wanted to put him on motorcycle forcefully but the informant anyhow escaped from there. It is further alleged that one mobile fell down at the place of occurrence which was handed over to the police. From the order of the learned Sessions Judge, it
Patna High Court Cr.Misc. No.94 of 2017 (2) dt.10-01-2017 2/2 appears that during investigation police has found that SIM of the aforesaid mobile was in the name of mother-in-law of this petitioner. Besides this there is no any other material brought by the police during investigation against this petitioner as per order passed by the learned Sessions Judge. In the circumstances, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Sono P.S. Case No. 181 of 2014, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Jamui, subject to the conditions as laid down under Section 438(2) Cr.P.C.
