HONOURABLE MR JUSTICE RAJIV ROY ORAL ORDER 18-09-2023 On call, no one appears on behalf of the petitioner although Mr Sanjay Pandey representing the Bihar Public Service Commission and Ms Nirmala Singh representing the Medical Counsel of India are present.

Both the Bihar Public Service Commission and the Medical Council of India have filed their respective counter affidavits in which it has been cleared that lowering the standard of medical education is impermissible. The counter affidavit of the Bihar Public Service Commission shows that the petitioner

Patna High Court CWJC No.2764 of 2018(3) dt.18-09-2023 2/2 failed thrice and she cannot claim now to lower the standard of medical education in view of Clause 5 of the Advertisement. Be that as it may, since the petitioner has chosen not to appear in the case, the writ petition stands dismissed for default.
