2. In the present case, the petitioner seeks bail in connection with Khushrupur P.S. Case No. 220 of 2025 registered for the alleged offences under Sections 25(1-b)(1)/26/35 of the Arms Act.

3. As per prosecution case, police received information about petitioner concealing firearms and ammunitions in his house. A raid was conducted and recovery of a country made katta and 11 live cartridges were made. The petitioner and co-accused son were apprehended from the spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

Learned counsel further submits that the recovery from the joint house of the petitioner is planted and nothing incriminating has been recovered from the conscious possession of the petitioner. The co-accused son Awadh Kumar has been granted bail by a Coordinate Bench vide order dated 09.09.2025 passed in Cr. Misc. No. 62590 of 2025 with the condition that the co-accused will be released after framing of charge. Learned counsel further submits that though the charge sheet has been submitted, charge has not been framed. The petitioner has got clean antecedent and is in custody since 23.06.2025.

5. Learned APP opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna City/concerned Court in connection with Khushrupur P.S. Case No. 220 of 2025, subject to the conditions mentioned in Section 480(3) of

Patna High Court CR. MISC. No.64875 of 2025(2) dt.17-09-2025 3/3 B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
