Petitioner seeks regular bail in connection with Sonpur PS Case No. 06 of 2019 registered for the offence under Sections 147 / 148 / 149 / 341 / 323 / 307 / 302 / 114 of the IPC Section 27 of the Arms Act.

As per the first information report the petitioner along with other accused persons surrounded the brother of the informant and the co-accused / Gabbar Rai allegedly fired upon the informant's brother due to which he died. Learned senior counsel for the petitioner submits that petitioner has falsely been implicated in this case and from perusal of the first information report it would be evident that the allegation against the petitioner is general and omnibus in nature and no overt act has been alleged against the petitioner

Patna High Court CR. MISC. No.1731 of 2022(2) dt.25-05-2022 2/2 except general allegation that other accused persons also assaulted the deceased by means of Butt of the pistol. Learned counsel next submits that the co-accused i.e. the order giver and the main accused who allegedly fired upon the deceased have been granted bail by this court vide Cr. Misc. Nos. 23138 / 2019 & 57233 / 2019 ( Annexure -2 and 3 to the bail petition) . The petitioner is in custody since 26th July 2021. Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that allegation against the petitioner is general and omnibus in nature, co-accused persons have been granted bail by this Court, the petitioner is in custody since 26-07-2021 and charge sheet has already been submitted , and as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IVth, Saran at Chapra in connection with Sonpur PS Case No. 06 of 2019. praful/- (Anil Kumar Sinha, J) U T
