1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 468, 420, 469, 120(B) of the Indian Penal Code and Section 30, 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, it is a case of recovery of incriminating liquor from the vehicle in question.
4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case and has not apprehended on the spot. The petitioner is not the owner and driver of the any seized vehicle and he has no concern to any liquor business and no recovery from the conscious
Patna High Court CR. MISC. No.65096 of 2023(2) dt.12-10-2023 2/2 possession of the petitioner. Petitioner has got three criminal antecedents and languishing in judicial custody since 28.08.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court No.1, Muzaffarpur in connection with Sakra P.S. Case No. 343 of 2019.
