JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Kursakanta P.S. Case No. 154 of 2016 for the offences punishable under sections 406, 409 and 420 of the I.P.C.

Allegedly, the petitioner misappropriated the Government fund which was allotted for providing scholarship to the SC/ST, EBC and OBC students.

Submission is of false implication and that the petitioner has got no criminal antecedent, there is no allegation of tampering with the prosecution witnesses, due to mistake of fact the present case has been instituted against the petitioner, the

Patna High Court Cr.Misc. No.51482 of 2016 (2) dt.19-12-2016 2/2 alleged amount of Rs. 3,46,200/- has already been deposited by the petitioner before the competent authority, vide Annexure-3 to the present application.

The learned A.P.P. submits that the petitioner is named in the FIR.

In the facts and circumstances as stated above, the petitioner, in the event his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Araria in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
