JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-09-2017 Heard the parties.
This application, for grant of anticipatory bail, arises out of Kishanpur P.S. Case No. 161 of 2016, disclosing offences under Sections 385, 353, 504 and 506/34 of the Indian Penal Code.
The informant of the case is Angan Bari Sevika
Patna High Court Cr.Misc. No.43253 of 2017 (2) dt.21-09-2017 2/3 at Centre No. 89. Allegedly, the petitioners demanded extortion from her and threatened of her dire consequences. It is also alleged that the petitioners obstructed her from discharging the official duty. Learned counsel for the petitioners has submitted that it is because of the voice, which the local people raised against the functioning of Angan Bari Centre that the present case has been lodged. It has further been submitted that the petitioners have no criminal antecedent, as stated in paragraph 3 of the application. Considering the nature of accusation, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs.
10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case No. 161 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
Patna High Court Cr.Misc. No.43253 of 2017 (2) dt.21-09-2017 3/3 the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
