This is a petition for grant of anticipatory bail for offence under Sections 272 and 273 of the Indian Penal Code and 47A of the Bihar Excise Act, 1915.
About four and half liters of foreign liquor was recovered from the possession of the petitioner. The petitioner has stated on oath that he has got no criminal antecedent and on the alleged date of recovery, possession of foreign liquor was not an offence. Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Jogbani (Bathnaha) P.S. Case No. 122 of 2016 to the satisfaction of the Chief Judicial Magistrate, Araria, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
