Learned counsel for the petitioner submits that this case is covered by the judgment dated 31.7.2017 passed in C.W.J.C. No. 11039 of 2016.

In such view of the matter, the authority will examine that if case of the petitioner is covered by that judgment, he will get the same benefit but if the authority finds that it is not covered the question of grant of benefit does not arise.

Patna High Court CWJC No.12316 of 2017 (2) dt.29-08-2017 This Court is not giving any opinion on the merit of the case.

With the aforesaid observation this writ petition is disposed of.
