JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The application is for grant of anticipatory bail for the offence under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is a case and counter case between the parties. The petitioner and the informant are relatives and though there is direct allegation of assault by the petitioner but the injuries found on the person of the informant are simple in nature.

Heard learned A.P.P. also.

In view of the facts as stated above, as there is a case and counter case and the injuries on the person of the informant are simple in nature, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Benipatti, District- Madhubani in connection withy Harlakhi P.S.Case No.146 of 2015 dated 26.12.2015 and concerned G.R. No.354 of 2014, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
