The sole petitioner who is in custody since 27.06.2017 in Kalyanpur P.S. Case No. 110 of 2017 registered for the offence under section 272, 273 of the Indian Penal Code 1860 and section 30(a)(b)(c)(d) of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that nothing was recovered from conscious possession of the petitioner. He submits that it was alleged as if recovery of some quantity of Indian make foreign liquor was effected on disclosure made by the petitioner, however this allegation has been disputed by learned counsel for the petitioner. Learned counsel for the petitioner has also drawn my attention to the

Considering the nature of accusation , clean antecedent and period of custody , let the petitioner Chuman Singh be enlarged on bail on furnishing bail bond of Rs. 10000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge of Excise, East Champaran at Motihari / concerned court in connection with Kalyanpur P.S. Case No. 110 of 2017.
