The petitioner, who successfully passed the matriculation examination from the Bihar School Examination Board (hereinafter referred to as, "Board") in the year 2019 has approached this Court seeking a direction upon the respondent Board to make necessary correction in his registration certificate of Class 10th as well as in the Matriculation Certificate, wherein in nationality column, it has been incorrectly mentioned as Non Indian.

3. Learned Advocate for the petitioner submitted that before appearing in the matriculation examination, he submitted his registration form for the examination, however, on account

Patna High Court CWJC No.14247 of 2025(2) dt.15-12-2025 2/3 of inadvertence, in the nationality column, "Others" was mentioned due to which error has occurred in the registration certificate as well as provisional and matriculation certificate.

Based upon the provisional certificate and the mark-sheet issued by the respondent Board, the petitioner took admission in the intermediate and successfully passed the same and for the first time, when the petitioner received the certificate of Secondary School Examination, 2019, he came to know that in the nationality column of the certificate, the petitioner is marked as Non Indian. The petitioner approached before the respondent Board and submitted an application along with affidavit duly sworn before the Executive Magistrate, besides other necessary documents. The petitioner also paid correction fee; however, he was asked to provide the admission register as well as leaving certificate and TC. On the directives of the Board, the petitioner has submitted all the necessary documents duly countersigned by the District Education Officer as well as the Principal of the School, in question, including the admission register, school leaving certificate and transfer certificate in the office of the Board on 30.07.2025.

5. Learned Advocate for the Board submitted that delay has occurred on the part of the petitioner as he has approached the Board after five years of the publication of

Patna High Court CWJC No.14247 of 2025(2) dt.15-12-2025 3/3 result. However, once the petitioner has submitted the required document, the same shall be considered by the officials of the Board and necessary action shall be taken, after proper verification of the document.

Having considered the submissions advanced by learned Advocate for the respective parties and taking note of the fact that all the required necessary documents, including the affidavit in support of the claim of the petitioner have submitted before the respondent Board and now the same is pending consideration for necessary correction in the registration certificate as well as in the Matriculation certificate, this Court deems it fit and proper to dispose off the writ petition with a direction to the respondent no. 3, to consider the claim of the petitioner and make necessary correction in the registration certificate as well as in original matriculation certificate after proper verification, preferably within a period of eight weeks, from the date of receipt/production of a copy of this order, in accordance with law.
