The petitioner seeks bail in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 120 of 2020 registered for the offence punishable under Section 411 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 06.08.2021, charge-sheet has been submitted in the case and has antecedent of eight cases and the informant alleges that petitioner along with other co-accused tried to steal the motorcycle of the informant which was parked in front of the rental house of the informant but on alarm Mithlesh was apprehended with motorcycle and also disclosed

Patna High Court CR. MISC. No.1651 of 2022(2) dt.24-05-2022 2/2 the name of the petitioner who managed to escape. The learned counsel submits that the petitioner was not arrested from the spot and his name came in the confessional statement of co-accused Mithlesh which has no evidentiary value.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 06.08.2021, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 120 of 2020 with a condition that one of the bailor shall be the father of the petitioner Shambhu Prasad.
