2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 127(2), 140(2), 140(3), 115(2), 351(2) and 3(5) of the B.N.S..
3. As per prosecution case, on 05.03.2025 at about 8 PM, all the F.I.R. named accused persons along with 8 to 10 unknown persons, variously armed, came to the office of informant and started assaulting him. It is further alleged that accused persons also kidnapped one Priya Kumari, however, informant managed to escape.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has
Patna High Court CR. MISC. No.64291 of 2025(2) dt.16-09-2025 2/2 committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired in this case during course of investigation. The only allegation against this petitioner is that he demanded his due amount before the alleged occurrence. There is no allegation of overt act against this petitioner.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case and general and omnibus nature of accusation, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist, Patna in connection with Ramkrishna Nagar P.S. Case No. 189 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
