JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Muffasil (Lakhaura) Case No. 430 of 2015 registered under Sections-392, 120(B) of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named but his name surfaced in confessional statement of co-accused and, on the aforesaid basis, the petitioner seeks privilege of anticipatory bail but in my view, the petitioner does not deserve the privilege of anticipatory bail because if, he is granted privilege of anticipatory bail, the investigating agency will not get opportunity to put the petitioner on test identification parade.

Patna High Court Cr.Misc. No.45131 of 2016 (2) dt.22-12-2016 2/2 Considering the aforesaid facts and circumstances as well as submission of the parties, the prayer for anticipatory bail of the petitioner stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
