The application is for grant of anticipatory bail for the offence under Sections 341, 323, 325, 307, 504 and 34 of the Indian Penal Code.

The allegation against the petitioner is that she thrown a child girl, causing injury to her.

It has been submitted on behalf of the petitioner that she has been falsely implicated in this case and there is no enmity between the parties.

Heard learned APP also, who has pointed out that there is direct allegation against the petitioner and the injury is grievous in nature on the part of the girl.

Patna High Court Cr.Misc. No.48979 of 2016 (2) dt.19-12-2016 2/2 Having heard both sides and in view of the fact that there is direct allegation against the petitioner and the injury is grievous in nature, it is not a fit case for grant of anticipatory bail and I am not inclined to grant anticipatory bail, let the petitioner is directed to surrender before the court below and the court below will consider the materials available on the record as well as considering this aspect that the petitioner is a lady would pass appropriate order without being prejudiced of the order of this Court.
