2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and Section 25 (1-b) a, 26 and 35 of the Arms Act.

3. The case of the prosecution, in short, is that the police received information that certain miscreants have assembled at the house of one Pintu Mishra with the intention of committing an offence. Acting upon the said information, the police conducted a raid at the said place and apprehended four persons. It is further alleged that the name of this petitioner has surfaced only on the confessional statement of apprehended persons. On this basis, the present FIR came to be instituted.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.62739 of 2025(2) dt.10-09-2025 2/2 connection with the present case. It is further submitted that the petitioner was not apprehended at the place of occurrence rather his name has framed due to his antecedents. It is also submitted that co-accused persons, namely, Kundan Kumar and Raja Babu have been granted bail by a co-ordinate Bench of this Court vide order dated 13.03.2023 and 28.08.2023 passed in Cr. Misc. Nos. 52875 of 2022 and 56002 of 2023 respectively and the case of this petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 16.02.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner have fifteen criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Goraul P.S. Case No. 404 of 2019 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM -1st Vaishali at Hajipur.
