JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the Economic Offence Unit and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Economic Offence Case No. 1 of 2012, disclosing offences under Sections 406,409,420,465,468,471 and 120B of the Indian Penal Code.
Petitioner, at the relevant point of time, was posted as Block Development Officer, Singhwara Block in the District of Darbhanga. Learned counsel for the petitioner submits that there were altogether three Block Development Officers posted in the said Block for different periods, who have been made accused in the case. One of the Block Development Officers has been granted anticipatory bail by this Court vide order dated 28.02.2014 passed in Cr. Misc. No.
39234 of 2013. He further submits that there is no chance of the petitioner tampering with the evidence or fleeing from the course of investigation or trial, if granted privilege of anticipatory bail. Considering the facts and circumstances of the case, this application is allowed. Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Economic Offence Case No. 1 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
