The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363/366A/34 of the Indian Penal Code.
The petitioner and others are alleged to have induced the daughter of the informant to go with them. The statement of the victim girl under Section 164 Cr.P.C. would reveal that though she has alleged that she was forcefully taken away by petitioner and others to a temple for the purpose of marriage with Kanhaiya Kumar but the police came thereat and rescued her. However, no one was arrested thereat. The aforesaid apparently shows that the matter is of
Patna High Court Cr.Misc. No.42763 of 2017 (2) dt.21-09-2017 P2/ love affairs and under pressure of the parents false statement is there.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 11th Additional Chief Judicial Magistrate, Motihari, East Champaran/successor Court in connection with Kesariya Police Station Case No. 59 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
