JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Ekma P.S. Case No. 93 of 2019, disclosing offences under Sections 447, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant by means of Garasi and also to assault the wife of informant.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and no garasi injury was found on the person of the informant. Learned counsels for the State as well as informant opposed the prayer for anticipatory bail and submitted that two injuries were found grievous in nature, however, he conceded

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Saran at Chapra, in connection with Ekma P.S.
