JUSTICE RAVI RANJAN ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Excise Act. It is contended that the petitioner has been falsely implicated in this case on the basis of statement of the co-accused Birju Singh from whose shop the liquor has been seized by the police.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Saroj Singh @ Saroj be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Nabinagar P.S. Case No.137 of 2015, on furnishing bail bond of
Patna High Court Cr.Misc. No.1116 of 2016 (2) dt.12-01-2016 2/2 Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
