The petitioner seeks regular bail in Bhabua P.S. Case No.269 of 2017 registered for the offence under Sections 395/427 of the I.P.C.
Petitioner is not named in the F.I.R. but later on his name transpired in course of investigation. He has been made accused on the basis of confessional statement of co- accused, namely, Kaushal @ Kaushal Patel Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and he remanded in other four cases. He is accused in
Patna High Court Cr.Misc. No.42921 of 2017 (3) dt.19-09-2017 2/3 four cases but in one case he has been acquitted and in three cases he is on bail. He is in custody for two months. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with observation that the learned trial court will verify the fact that the charge sheet has been submitted and if submitted, he will release the petitioner on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M.,Kaimur(Bhabua) in Bhabua P.S.
Case No.269/17subject to the condition that (i) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii)The petitioner will not induce any witness or tamper with the evidence. (iii) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on
