Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 411/34 of the Indian Penal Code. It is alleged that from different persons sixteen A.T.M. Cards and four mobiles were recovered from the vehicle of the petitioner.

It is submitted by the learned counsel for the petitioner that recovery of A.T.M. itself does not constitute any offence. There is no accusation of misusing the A.T.M. Card. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. When the other persons from whom A.T.M. Card has been recovered have been granted regular bail vide Cr. Misc. Nos. 40812 of 2015, 46177 of 2015

Patna High Court Cr.Misc. No.1262 of 2016 (2) dt.11-01-2016 and 40823 of 2015.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gaya Civil Lines P.S. Case No. 237 of 2015, pending in the court of learned Chief Judicial Magistrate, Gaya.

With this observation this application is disposed of.
