JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-06-2023 Though the present writ petition has been filed for quashing the notice dated 14.10.2022, issued by the Circle Officer, Danapur, under Section 3 of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as the Act, 1956), however, the leaned counsel for the petitioners seeks liberty on behalf of the petitioners to file the requisite objection before the Circle Officer, Danapur, Patna, however, seeks some protection during the interregnum period.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioners to file their objections before the Circle Officer, Danapur, Patna, in case the aforesaid

Patna High Court CWJC No.16131 of 2022(2) dt.19-06-2023 3/3 encroachment proceedings are still pending, within a period of four weeks from today, whereupon the Circle Officer, Danapur, Patna, shall consider the same and pass the final order under Section 6(1) of the Act, 1956, within a period of six weeks, thereafter.

It is needless to state that for a period of twelve weeks from today, status quo, existing as on today qua the land / houses of the petitioners, shall be maintained. (Mohit Kumar Shah, J) Ajay/- U
