This is a petition for grant of anticipatory bail for offence under Sections 376ii(i), 201 and 34 of the Indian Penal Code and 4 and 21 of the Protection of Children from Sexual Offences Act.
The allegation of commission of rape on a minor girl is against the co-accused, Harish Chandra Sah. The petitioner is son of Harish Chandra Sah. Allegation is that for settlement of the aforesaid occurrence a panchayati was held before Mukhiya and compensation amount was offered to the victim and the petitioner hurled abuses there.
Considering the nature of the allegation against the petitioner, above named, he, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Mahila P.S. Case No. 105 of 2016 to the satisfaction of the Additional Sessions Judge-cumSpecial Judge, POCSO Act, Muzaffarpur, or successor Court,
Patna High Court Cr.Misc. No.51780 of 2016 (2) dt.20-12-2016 subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
