This application has been filed for quashing the order dated 02.11.2021 passed by the learned Sessions Judge, Purnia in Cr. Revision No. 174 of 2019/ CIS No. 174 of 2019 whereby and where under the learned Sessions Judge dismissed the Cr. Revision filed by the petitioners and confirmed the order dated 24.07.2019 passed by the learned C.J.M. Purnia in Sadar P.S. Case No. 461 of 2018 whereby and where under the learned Magistrate took cognizance for the offences under Sections 419,

Patna High Court CR. MISC. No.1697 of 2022(2) dt.17-03-2023 2/2 420, 468, 504 and 506 read with Section 34 of the IPC against the petitioners.

The petitioner knowing fully well that the land does not belong to the vendor has purchased it at a throw away price. These kinds of persons who are purchasing land of others at throw away price from persons who are not the owners of the land are not entitled to any relief.

Accordingly, this application is dismissed with liberty to the petitioners to raise all his grounds at the stage of trial. (Sandeep Kumar, J) Shishir/Vikas U T
