1. Heard both the parties.

2. The petitioner seeks bail in anticipation of his arrest in connection with Bhairvasthan P.S. Case No. 74 of 2021, dated 25.06.2021, instituted for the offences under Sections 399, 402, 414 of the I.P.C.

3. The petitioner submits that his name has been wrongly included in the allegations which were essentially against those four persons, who were travelling in the vehicle. The petitioner was not present at that time, but his name has been added by the Police.

4. Considering the submission, it is noticed that the patrolling party had stopped the Pickup Van wherein some people were caught while some of them ran away which

Patna High Court CR. MISC. No.63445 of 2022(2) dt.24-04-2023 2/2 included the petitioner. The people who were sitting in the Scorpio were also stopped. The Scorpio was found to be stolen.

5. Taking into consideration the nature of allegation and that investigation may be required to be conducted from the petitioner, who is said to have been ran away from the place of incident, I am not inclined to grant anticipatory bail to the above named petitioner.

6. Accordingly, the prayer for anticipatory bail is rejected.
