2. The petitioner seeks regular bail in connection with S.T. No. 45 of 2023, arising out of Chandramandih P.S. Case No. 33 of 2022, registered for the offence punishable under Sections 302, 304-B/34 of the Indian Penal Code.

3. As per prosecution, the petitioner is in custody for causing the death of his wife. Charge-sheet has been submitted under section 306 of the Indian penal Code since the case has been found true u/s 306 of the Indian Penal Code.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He has no criminal antecedent and he is in jail since 11.09.2022.

5. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.67298 of 2023(2) dt.17-10-2023 2/2 for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge- 3rd Jamui, in connection with S.T. No. 45 of 2023, arising out of Chandramandih P.S. Case No. 33 of 2022.
