JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 04-04-2018 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner, being the husband of the victim, has renewed the prayer for bail in Gogri P.S. Case No. 270 of 2015 (Sessions Trial No. 48 of 2016) registered for the offences punishable under Sections 323, 498A and 304B/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after two years of marriage for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that he is languishing in custody since 03.10.2015. The
Patna High Court Cr.Misc. No.43970 of 2017 (3) dt.04-04-2018 accusation against the petitioner is based only on suspicion and due to the alteration of charge the trial got delayed. The report of the learned Incharge Sessions Judge, Khagaria dated 30.01.2018 reflects that the matter is fixed for argument on behalf of the defence.
In the circumstances, it is expected from the learned trial Court to conclude the trial, if the same has already not been concluded, within a period of two months. Considering the advanced stage of trial, this Court is not inclined to interfere. Accordingly, this application is disposed of.
