Petitioner is in custody in connection with Kishanganj P.S. Case No. 258 of 2019 for the offence under sections 379 of the Indian Penal Code.

Learned counsel for the petitioner would submit that allegation against this petitioner is that he was involved in theft of motorcycle of the informant. He submits that motorcycle was not recovered from the conscious possession of the petitioner. The real culprit has left the motorcycle and flew away and this innocent petitioner has been taken into custody. Learned counsel for the petitioner submits that petitioner is in custody since 9.7.2019.

Considering the submission of the counsel for the

No.60317 of 2019(2) dt.27-09-2019 2/2 petitioner that nothing was recovered from the conscious possession of the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 258 of 2019 subject to the condition that bailors should be family members of the petitioner.
