JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 30-08-2018 A supplementary show cause has been filed today on behalf of the Power Company and what has transpired from the fresh affidavit is that a sum of Rs.87,263/- has been found payable to the petitioner. A Cheque bearing Number 990382 dated 27.08.2018 for the said amount has been prepared in the name of the petitioner and Mr. Ojha, learned counsel representing the Power Company submitted before this Court that the original cheque will be made available to the learned counsel for the petitioner today itself.

Even though, learned counsel for the petitioner submits that the petitioner would not be satisfied with this amount, this Court cannot see any reason to proceed with the contempt proceeding. If at all the petitioner has any other claim he will be free to take recourse to the remedy available in law.

This application stands disposed off.

On the last occasion this Court had made certain observations pointing out to Mr. Ojha and he was requested to take some efforts to ensure that the matter should be considered by the Opposite Parties in true terms and spirit of the order of the learned writ Court. This Court is happy with the efforts taken by Mr. Ojha by virtue of which this amount has been paid. The receipt showing handing over of the Cheque to learned counsel for the petitioner shall be filed by Mr. Ojha, learned counsel representing the Power Company. (Rajeev Ranjan Prasad, J) R.R.Ojha.
