The petitioner apprehends his arrest in Sohsarai P.S. Case No.129 of 2019 registered under Sections 363, 366(A) and 34 of the Indian Penal Code.

The informant alleged that the petitioner and his parents kidnapped her minor daughter.

Learned counsel for the petitioner submits that the victim after having come to know about the institution of the case returned and made statement under Section 164 of the Cr.P.C. She disclosed her age to be 17 years. The victim disclosed that she voluntarily left her house and went to Delhi along with the petitioner. The petitioner did not misbehave with her.

Having considered the facts that the victim herself

No.66696 of 2019(2) dt.24-10-2019 2/2 denied the factum of her kidnapping and she disclosed that she voluntarily went to Delhi along with the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda in connection with Sohsarai P.S. Case No.129 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
