The petitioner apprehends his arrest in connection with Atri P.S. Case No. 163 of 2022 registered under Sections 354(A), 354(B) and 448 of the I.P.C. and Section 8/12 of the Prevention of Children from Sexual Offences (POCSO) Act. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to village politics and land dispute. There is general and omnibus allegation against the petitioner. Petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending
Patna High Court CR. MISC. No.63583 of 2022(2) dt.09-01-2023 2/2 that from perusal of the first information report, it is apparent that there is direct allegation of sexual harassment against the petitioner. Hence, this is not a fit case for grant of anticipatory bail.
Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner.
